The agreement between you and Claimoniz.

1. Introduction

The Claimoniz Platform (“Claim” or the “Claim Platform”) is operated by Claim Holding Company, a Saudi closed joint-stock company established under the laws of the Kingdom of Saudi Arabia, holding a Fintech Sandbox License from the Saudi Central Bank (SAMA) to provide healthcare-claims financing services.

Claimoniz’s head office is located in Riyadh, Kingdom of Saudi Arabia.
These Terms and Conditions govern the use of all services offered through the Claim Platform, including its website, web applications, and mobile applications.

2. Acceptance of Terms

Before using the Claimoniz website or app, please read these Terms carefully.
By accessing or using the platform, you agree that you:

  • Have read and understood these Terms and Conditions.
  • Accept and will comply with them in full.

If you do not agree, you must refrain from using the Claimoniz Platform.

Claimoniz reserves the right to amend these Terms at any time for legal, regulatory, or security reasons. Updates will be announced at least 30 days in advance, and continued use after updates constitutes acceptance of the revised Terms.

3. Related Policies

These Terms and Conditions must be read in conjunction with the following:

  • Claimoniz Privacy Policy
  • Claimoniz FAQ and Platform Guidelines
  • Any specific service agreements applicable to financing requests or digital signatures

4. About Claimoniz

Claimoniz is a regulated fintech platform that enables healthcare providers—including clinics and hospitals—to receive early financing for their approved or pending insurance claims.

Claimoniz integrates with official systems and partners to perform automated verification, including:

  • Wathq.sa – verification of commercial registration data (Ministry of Commerce).
  • Authentica.sa / Nafath – identity and ownership verification.
  • SingleView.com.sa – IBAN validation.
  • Faceki.com – AML and KYC checks.
  • ANB Developer API / PayTabs.com – virtual IBAN creation and loan disbursement.
  • Rased.ai – fraud detection.
  • Emdha.sa – digital signing of financing agreements.
  • OpenAI API – AI-based claim validation against CCHI and NPHIES.
  • Deloitte SOC & Splunk – continuous cybersecurity monitoring.

5. Eligibility for Registration

  1. You must be at least 18 years old (Gregorian calendar) and have full legal capacity to contract.
  2. You must register either as a Clinic / Healthcare Provider (financing applicant) or an Authorized Representative.
  3. Claimoniz reserves the right to reject registration if legal or compliance requirements are not met.
  4. You must provide accurate information and supporting documents as requested. Any false or misleading information will result in account suspension or legal liability.
  5. Claimoniz may verify your identity and ownership through its integrated third-party services.

6. License to Use the Platform

Unless otherwise stated, all intellectual property rights in the Claimoniz Platform and its materials belong to Claimoniz Company.
You may view and download content for internal or lawful use only, and may not:

  • Reproduce or republish any platform materials without written permission.
  • Sell, rent, sub-license, or publicly display platform content.
  • Modify or redistribute any materials except as expressly allowed.
  • Use platform content for commercial purposes other than Claim’s financing services.

 

7. Prohibited Use

Users must not:

  • Use the platform unlawfully, fraudulently, or in a manner that damages its availability or reputation.
  • Upload, transmit, or distribute viruses or malicious code.
  • Conduct data scraping or unauthorized information extraction.
  • Send unsolicited commercial messages.
  • Use the platform for advertising or marketing without written authorization.

8. Service Fees

  1. Users must pay applicable service fees as displayed within Claimoniz.
  2. Clinics applying for financing are charged administrative and due-diligence fees to cover data validation, document verification, credit analysis, and AML screening.
  3. Claimoniz reserves the right to adjust fees at any time with prior notice.
  4. Payments must be made through the platform’s approved payment channels.

9. Warranties

Claimoniz does not warrant that the platform will be available without interruption or free from errors or viruses.
All services are provided “as is” without express or implied warranties, except where required by Saudi law.

Users acknowledge that:

  • They meet the eligibility requirements.
  • The data provided is accurate.
  • They will not misuse Claimoniz’s services.
  • They comply with Saudi laws and are not listed on any sanctioned-entity lists.

10. Limitation of Liability

Claimoniz shall not be liable for:

  • Any indirect, special, or consequential losses.
  • Loss of profits, goodwill, or business opportunity.
  • System downtime or data loss caused by technical or external events.

Claimoniz’s total liability shall not exceed the fees paid by the user for the relevant service.

11. Default and Collection

If a clinic fails to remit financing proceeds upon claim settlement, Claimoniz may take lawful collection actions, including:

  • Contacting the borrower and restructuring payment schedules.
  • Executing promissory notes or guarantees.
  • Referring the case to a licensed collection agent.

Collection costs and legal fees may be deducted from recovered amounts.

12. Conflicts of Interest

Claimoniz ensures transparency and impartiality in all dealings.
Employees, board members, or partners must not engage in any transaction that creates a conflict of interest.
Any potential conflict will be managed in accordance with SAMA’s governance standards.

13. Intellectual Property

All intellectual property rights related to the Claimoniz Platform, codebase, designs, logos, documentation, and databases remain the exclusive property of Claim Holding Company.
Users grant Claimoniz a limited license to use uploaded data solely for service delivery and compliance.

14. Information Security & Data Protection

Claimoniz protects all personal and business data using technical and organizational safeguards consistent with SDAIA PDPL and SAMA Cybersecurity Framework.

Users agree that:

  • Claimoniz may share data only with approved third-party verification and banking partners.
  • They will maintain confidentiality of credentials.
  • They will immediately report any unauthorized access.

15. Assignment of Rights

Claimoniz may assign or subcontract its rights and obligations without prior notice, provided it remains compliant with Saudi law.
Users may not assign or transfer their accounts or obligations.

16. Governing Law & Jurisdiction

These Terms and any disputes arising from them are governed by the laws of the Kingdom of Saudi Arabia.
Jurisdiction lies with the Financial Disputes and Violations Committee (SAMA) in Riyadh.

17. General Provisions

  • Force majeure events beyond Claimoniz’s control (e.g., system outages, wars, natural disasters) excuse performance.
  • The Privacy Policy and Cookie Policy are integral parts of these Terms.
  • If any clause is invalidated by a competent court, the remaining provisions remain enforceable.
  • Electronic notifications sent to your registered email or dashboard are deemed legally received the following day.

1. المقدمة

تُدار منصة Claimoniz («المنصة» أو «كلـيم») من قبل شركة كلـيم القابضة، وهي شركة مساهمة مقفلة تأسست وفق أنظمة المملكة العربية السعودية، وتحمل ترخيص البيئة التجريبية من البنك المركزي السعودي (ساما) لتقديم خدمات تمويل المطالبات التأمينية للقطاع الصحي.
يقع المقر الرئيسي للشركة في مدينة الرياض – المملكة العربية السعودية.
تنطبق هذه الشروط والأحكام على جميع مستخدمي المنصة وخدماتها الإلكترونية.

2. قبول الشروط

باستخدامك لمنصة Claimoniz أو موقعها الإلكتروني، فإنك تقر بما يلي:

  • قرأت وفهمت الشروط والأحكام بالكامل.
  • توافق على الالتزام بها دون قيد أو شرط.

في حال عدم موافقتك، يجب عليك التوقف عن استخدام المنصة فوراً.
تحتفظ Claimoniz بحقها في تعديل الشروط في أي وقت لأسباب قانونية أو تنظيمية، وسيتم إشعار المستخدمين بالتعديلات قبل 30 يوماً من تطبيقها.

3. السياسات المرتبطة

يجب قراءة هذه الشروط والأحكام مع كل من:

  • سياسة الخصوصية لمنصة Claimoniz
  • سياسة الكوكيز والأسئلة الشائعة
  • أي اتفاقيات خدمة إضافية ذات صلة بطلبات التمويل أو التوقيع الرقمي.

4. عن المنصة

تُعد Claimoniz منصة تقنية مالية مرخصة تُمكّن العيادات والمستشفيات من الحصول على تمويل فوري مقابل مطالباتها التأمينية المستحقة لدى شركات التأمين.

وتتكامل المنصة مع عدة أنظمة وجهات رسمية للتحقق من الهوية والملاءة، وتشمل:

  • Wathq.sa للتحقق من السجل التجاري.
  • Authentica.sa / Nafath للتحقق من الهوية والملكية.
  • SingleView.com.sa للتحقق من رقم الآيبان.
  • Faceki.com لفحص مكافحة غسل الأموال (AML).
  • ANB / PayTabs.com لإنشاء الآيبان الافتراضي وصرف التمويل.
  • Rased.ai للكشف عن الاحتيال.
  • Emdha.sa للتوقيع الرقمي.
  • OpenAI API للتحقق من صلاحية المطالبات التأمينية عبر CCHI وNPHIES.
  • Deloitte & Splunk للأمن السيبراني وإدارة المراقبة الأمنية المستمرة.

5. شروط التسجيل والأهلية

  • يجب أن يكون المستخدم بالغاً 18 عاماً على الأقل ويتمتع بالأهلية النظامية.
  • التسجيل متاح فقط للعيادات أو من يمثلها قانونياً.
  • تحتفظ Claimoniz بالحق في رفض التسجيل إذا لم تتحقق متطلبات الامتثال أو التحقق.
  • يتحمل المستخدم المسؤولية الكاملة عن دقة المعلومات المقدمة.
  • قد تقوم Claimoniz بالتحقق من الهوية والملكية من خلال واجهات الربط الرسمية المذكورة أعلاه.

6. الترخيص باستخدام المنصة

جميع حقوق الملكية الفكرية في المنصة ومحتواها مملوكة لشركة كلـيم القابضة.
لا يجوز للمستخدم:

  • نسخ أو إعادة نشر أو بيع أي محتوى من الموقع دون موافقة خطية مسبقة.
  • تعديل أو توزيع المواد لأي غرض تجاري غير متعلق بخدمات التمويل.
  • استخدام المنصة بطريقة تضر بأمنها أو تؤثر على استقرارها.

7. الاستخدامات المحظورة

يُمنع المستخدم من:

  • استخدام المنصة في أي نشاط غير قانوني أو احتيالي.
  • نشر أو إرسال فيروسات أو برامج ضارة.
  • جمع بيانات المستخدمين أو محتوى المنصة بوسائل آلية.
  • إرسال رسائل تسويقية غير مصرح بها.
  • استخدام المنصة لأغراض دعائية دون إذن كتابي من Claimoniz.

8. الرسوم والخدمات

  • تلتزم العيادات بسداد الرسوم الإدارية وأتعاب دراسة الجدارة الائتمانية والفحص الفني للمطالبات.
  • تُعرض جميع الرسوم داخل المنصة وتُسدد عبر قنوات الدفع المعتمدة.
  • تحتفظ Claimoniz بحق تعديل الرسوم بعد إشعار مسبق.

9. الضمانات

لا تضمن Claimoniz أن المنصة ستكون متاحة باستمرار أو خالية من الأخطاء أو الفيروسات.
تُقدَّم الخدمات «كما هي» دون أي ضمانات صريحة أو ضمنية إلا ما نص عليه النظام السعودي.

10. حدود المسؤولية

لا تتحمل Claimoniz أي مسؤولية عن:

  • الخسائر غير المباشرة أو التبعية.
  • فقدان الأرباح أو السمعة أو البيانات.
  • الأعطال التقنية الخارجة عن سيطرتها.

ويقتصر الحد الأقصى لمسؤوليتها على قيمة الرسوم المدفوعة عن الخدمة المعنية.

11. التخلف عن السداد والتحصيل

في حال تخلف العيادة عن سداد المستحقات بعد تحصيل المطالبات من شركة التأمين، يحق لـ Claimoniz اتخاذ الإجراءات النظامية بما في ذلك:

  • التواصل مع المقترض وجدولة السداد.
  • تنفيذ الضمانات أو الكمبيالات.
  • إحالة الحالة إلى جهة تحصيل معتمدة.
    تُخصم تكاليف التحصيل القانونية والإدارية من المبالغ المحصلة.

12. تضارب المصالح

تلتزم Claimoniz بالشفافية والحياد، وتُدار أي حالات تضارب محتملة وفق ضوابط ساما، لضمان عدم تأثير المصالح الشخصية على الأداء المهني.

13. الملكية الفكرية

تحتفظ Claimoniz بكافة حقوق الملكية الفكرية المتعلقة بالمنصة، بما في ذلك الأكواد والتصاميم والشعارات والبيانات.
ويُمنح المستخدم ترخيصاً محدوداً لاستخدام بياناته فقط لأغراض تقديم الخدمة.

 

14. أمن المعلومات وحماية البيانات

تلتزم Claimoniz بتطبيق أعلى معايير الأمن السيبراني المعتمدة من سدايا وساما.
ويقرّ المستخدم بما يلي:

  • السماح بمشاركة البيانات مع الجهات المتكاملة المعتمدة.
  • الحفاظ على سرية بيانات الدخول.
  • الإبلاغ فوراً عن أي وصول غير مصرح به.

15. التنازل عن الحقوق

يجوز لـ Claimoniz نقل أو تفويض أي من حقوقها أو التزاماتها دون إشعار مسبق طالما تم ذلك وفق الأنظمة السعودية.
ولا يجوز للمستخدم التنازل عن حسابه أو التزاماته لأي طرف آخر.

16. القانون والاختصاص القضائي

تخضع هذه الشروط لأحكام أنظمة المملكة العربية السعودية، ويختص لجنة الفصل في المنازعات والمخالفات التمويلية (ساما) في الرياض بالنظر في أي نزاع ينشأ عنها.

17. أحكام عامة

  • تُستثنى من الالتزام الحالات القاهرة الخارجة عن الإرادة مثل الكوارث والحروب.
  • تُعد سياسة الخصوصية جزءاً مكملاً لهذه الشروط.
  • في حال بطلان أي بند، تبقى باقي البنود سارية المفعول.
  • تُعتبر الإشعارات الإلكترونية المرسلة عبر البريد أو لوحة التحكم مستلمة في اليوم التالي للإرسال.
